Please note ATV/UTV enthusiasts.  You can copy and paste the following letter.      Re: S1946 (Ritchie) / A4971 (Russell) To Whom it May Concern, I am writing to ask you for your support for the above mentioned legislation which amends the definition of an All Terrain Vehicle or "ATV".  Currently the defined weight of an ATV is 1000 lbs or less.  Please support and vote for Senate Bill S1946 and Assembly Bill A4971. The ATV industry has expanded as a result of advancements in technology and new vehicles have been created.  Many of these vehicles have been referred to as side-by-sides, or Utility Vehicles (UTVs) and generally weigh more than traditional ATVs; up to 1500 lbs.  New York State has yet to update regulations that would permit these vehicles to be legally registerd in our state.  This has prompted current owners to register their UTVs in other states or to disregard registration altogether. Amending the definition of an ATV by increasing the weight limit to 1500 lbs. would allow owners to register their vehicles in New York.  This would generate additional revenue through registration as well as tax revenue through the anticipated increase in sales of UTVs as a result of the vehicles being legal. In addition to increased State revenue, there are other benefits in allowing UTV usage in New York.  UTVs have a wider tire span which spreads out the total weight of the vehicle creating a less significant impact on the environment.  Allowing UTVs to be legally registered also means that such vehicles will be used on public trail systems rather than unmarked challenging terrain.  Increased safety features include seat belts and roll-over bars.  Side-by-side vehicles also allow passengers to sit next to each other rather than holding on from behind.  Currently, special permits must be filed in order for persons with disabilities to gain access to certain trails on state land.  The ability to register UTVs would eliminate this step allowing for safer, immediate access for handicapped individuals.  Furthermore, many of these vehicles have a maximum speed of 45 mph compared to ATVs which may reach speeds up to 70 mph.  We believe all these factors will prompt a generally slower, safer overall experience on designated trails.  For the reasons stated above, I request your support in amending the traffic law in relation to the definition of All Terrain Vehicles.  Please support and vote for Senate Bill S1946 and Assembly Bill A4971.  Thank you for your attention in this matter.
